1. Who we are

2. Website and email

Website data

This website does not contain Chimp Brands analytics, advertising technology, tracking pixels or non-essential cookies. Its code does not store visitor information in your browser.

Like most websites, the hosting and network providers used to deliver and secure the site may process technical request information such as your IP address, browser and device information, requested page, referring page, and the date and time of a request. We use this information only where necessary to deliver, protect and troubleshoot the site. Our lawful basis is our legitimate interest in operating a reliable and secure company website.

Product updates

If you ask us to keep you posted, we collect your email address, the products you select, the page where you signed up, and records of your consent and email confirmation. Encharge, our email automation provider, also processes a temporary submission identifier and ordinary technical and delivery information needed to accept the form, confirm your address, deliver messages and manage unsubscribes.

We use this information to send the occasional Chimp Brands product news and release updates you requested. Our lawful basis is your consent. The form uses double opt-in, so we will ask you to confirm the address before sending those updates. You can withdraw consent at any time using the unsubscribe link in an email or by contacting support@chimpbrands.com.

The form does not store your email address, selections or temporary submission identifier in cookies, local storage or session storage. We do not send your email address to an analytics or advertising service.

Emails and support requests

If you contact us, we receive the information you provide, such as your name, email address, message, attachments and ordinary email metadata. We use it to respond, provide support, maintain an appropriate record of the conversation, protect our rights and improve our products.

Depending on the context, our lawful basis is taking steps at your request before entering a contract, performing a contract, complying with law, or our legitimate interests in answering enquiries and supporting our products. You are not required to contact us, but we cannot respond without a working reply address and enough information to understand the request.

3. Earlier

Earlier is a general-wellbeing iPhone app designed to help people move their wake time gradually. It is not a medical device, medical advice or a service for diagnosing, preventing or treating a sleep disorder.

Information stored on your device

Earlier does not require an account. The current app stores its active data locally in an Apple App Group container shared by the Earlier app and its extension. This can include:

• your chosen name and reasons for changing your morning;
• sleep and wake times, sleep-duration preference and time zone;
• plan settings, target, pace and progress;
• alarm identifiers, snooze activity, check-ins and morning history; and
• notification and reminder preferences.

The current version does not send this sleep-plan information to Chimp Brands, does not use HealthKit, and does not request your location. It does not use CloudKit for cloud synchronisation.

Apple system services

Earlier uses Apple’s AlarmKit to schedule wake alarms and, if you enable them, local notifications for wind-down and morning check-ins. Depending on your choices and device settings, your chosen name, reason, plan day, sleep time or wake time may be visible on Apple system surfaces such as an alarm, notification, Lock Screen, Live Activity or Dynamic Island.

Purchases and subscriptions are processed by Apple through the App Store. Earlier reads Apple-verified subscription status to determine access, but Chimp Brands does not receive payment-card details through the app. Apple may provide Chimp Brands with App Store sales, diagnostic or crash information according to Apple’s systems and your settings. Apple’s own terms and privacy information apply to its processing.

Analytics, advertising and tracking

The current app does not include Chimp Brands analytics, advertising, cross-app tracking or third-party crash-reporting SDKs.

Deleting Earlier data

You can delete Earlier’s active local data from the app’s You tab. This also cancels the alarm currently recorded by Earlier and removes Earlier’s pending and delivered program notifications. It does not cancel an App Store subscription, erase Apple’s purchase records, revoke system permissions or guarantee deletion from Apple-managed device backups. Subscriptions must be managed through the App Store.

4. Nostos

Nostos is a pre-release writing studio for Mac and iPhone. Its data practices may be updated before public distribution, and this notice will be updated before a materially different version is released.

Writing and library data

Nostos stores writing-library information such as projects, documents, plain-text content, task-list text, tags, references, attachments, document history, preferences and related metadata in its managed library on your device. Files you deliberately link, import, export or back up may also exist in locations you choose outside that managed library.

iCloud and network access

Where a signed Nostos build has its iCloud capability available, Nostos uses Apple CloudKit to synchronise supported library data through the user’s private iCloud account. Cloud availability depends on Apple account, device and service settings. Apple processes that synchronised data under its terms and privacy policy; Chimp Brands does not operate a separate Nostos account server.

If a Nostos document contains a remotely hosted web image and you use a preview or export feature that loads it, the image host may receive ordinary request information such as your IP address and user agent. Links you choose to open are handled by your browser or the relevant external service.

If you link a Finder folder, Nostos stores a security bookmark, the folder name and path, and local cached information used to detect and merge changes. Unlinking the folder removes those records from Nostos but does not delete the original files. If the folder is managed by iCloud Drive or another file provider, that provider’s privacy terms also apply.

Analytics and tracking

The current pre-release code does not include advertising, cross-app tracking, Chimp Brands analytics or a third-party crash-reporting SDK.

Exports, backups and deletion

Nostos supports local exports and safety backups. Exported files and backup archives are stored in locations available to you and are not separately encrypted by Nostos. Deleting a document from the active library may not immediately remove copies from safety backups, exported files, device backups or iCloud retention systems. You are responsible for deleting copies you placed outside the managed library. Product controls and support guidance will explain how to remove active library data and locally accessible backups before launch.

5. Nostos Focus

Nostos Focus is not yet publicly distributed. The current development build is a feasibility shell and is not trusted with permanent task data. It does not currently include a production durable task store, website-blocking runtime, background agent, advertising, analytics or third-party crash reporting.

Its final privacy information will be published before release and will reflect the behaviour of the shipping version, including any task storage, Nostos integration, timers, activity information, distraction-control features, Apple services and deletion controls that are actually present.

6. Sharing, service providers and international transfers

We do not sell personal information. We may make information available only where necessary to:

• hosting, network and IT providers that help us run the website;
• Encharge, which receives product-update form submissions and helps us manage consent, confirmation, delivery and unsubscribes;
• email providers that help us answer messages;
• Apple, where you use App Store purchases, Apple system services, diagnostics or CloudKit;
• professional advisers, insurers, courts, regulators or public authorities where reasonably necessary; or
• a successor in connection with a genuine corporate reorganisation, subject to appropriate protection.

Some providers may process information outside the United Kingdom. Where UK data-protection law requires it, we rely on an adequacy regulation or suitable contractual and organisational safeguards. You may contact us for more information about safeguards relevant to your data.

We require providers acting for us to protect personal information appropriately. Third-party services that you choose to use, including Apple and remotely hosted content, also process information under their own terms and privacy notices.

7. Retention and deletion

• Website logs: retained only for the period reasonably necessary to deliver, secure and troubleshoot the site, then deleted or de-identified unless a longer period is needed to investigate an incident or comply with law.
• Product updates: subscription information is retained while you remain subscribed. If you unsubscribe, we may retain the minimum information needed on a suppression list so that we continue to respect your choice. Consent and delivery records may be retained for as long as reasonably necessary to demonstrate compliance, resolve a complaint or establish legal claims.
• General and support email: normally retained for up to 24 months after the matter is closed. Material needed for a contract, dispute, tax record or legal obligation may be retained for the relevant statutory or limitation period.
• Earlier active data: retained on your device until you delete it using the app controls or remove it through applicable device-management controls, subject to Apple-managed backups and records.
• Nostos data: retained in the local library, local safety backups, user-chosen exports, linked folders and any applicable private iCloud store until removed through the relevant product, file-system or Apple controls, subject to recovery and backup retention.

Because Earlier and the Nostos products do not currently create a Chimp Brands user account, there is no remote product account to delete. A product-update subscription is a mailing-list record rather than a product account. Email support@chimpbrands.com if you want help with either.

8. Your data-protection rights

Depending on the information and lawful basis, UK data-protection law may give you rights to request access, correction, erasure, restriction, portability, or to object to processing. Where processing relies on consent, you may withdraw that consent. These rights are not absolute and exemptions may apply.

To exercise a right, email support@chimpbrands.com. We may need to verify your identity before acting. There is normally no fee.

You may complain to the UK Information Commissioner’s Office. See ico.org.uk/make-a-complaint or telephone 0303 123 1113. We would appreciate the opportunity to address your concern first.

We do not use the information described in this notice to make solely automated decisions that have legal or similarly significant effects.

9. Changes and contact

We may update this notice when our products, suppliers or legal obligations change. The current version will always show its effective and last-updated dates. If a change materially affects information already received by us, we will take reasonable steps to provide additional notice where required.
